Summary

The body named conditionally in the Absentees’ Property Law, 5710-1950: if a Development Authority is established under a Law of the Knesset, it is the only purchaser to whom the Custodian may sell vested immovable property, and the only lessee, apart from a cultivating or developing lessee, to whom he may lease such property for over six years (Absentees’ Property Law, 5710-1950, PDF p.9-10).

Details

  • Sale: section 19(a)(1) bars the Custodian from selling or otherwise transferring ownership of vested immovable property, provided that if a Development Authority is established under a Law of the Knesset, he may sell the property to that Authority at a price not less than the property’s official value, as section 19(d) computes it (PDF p.9-10).

  • Lease: under section 19(a)(2) he may lease such property to the Authority for over six years, stipulating annual rent not less than 4.8 per cent of the official value (PDF p.9).

  • The Law as printed in this file does not itself establish the Authority and gives no date for its establishment; Sitta’s account of a Development Authority (Transfer of Property) Law of July 1950 is recorded on Absentee Property Law.

  • In the Basic Law: Israel Lands (1960) the Development Authority is one of the three holders of “Israel lands” whose ownership shall not be transferred by sale or in any other manner, except classes determined by Law (Basic Law: Israel Lands (1960), PDF p.1).

  • The Israel Lands Administration Law, 5720-1960 amends the Development Authority (Transfer of Property) Law, 5710-1950: the Authority’s competence is expressly subject to the Basic Law: Israel Lands and the Israel Lands Law, 5720-1960; save with the Israel Lands Council’s approval it shall not sell, transfer, let or lease non-urban Israel lands over 100 dunams; every act under its section 3 in respect of Israel lands shall be done by the Israel Lands Administration; its section 4 is repealed and part of its section 5 deleted (Israel Lands Administration Law, 5720-1960 (1960), PDF p.2).
