Summary

The court provided for by Article 14 of the Covenant of the League of Nations to which, under Article 26 of the Mandate for Palestine, any dispute between the Mandatory and another League Member over the interpretation or application of the mandate’s provisions is to be submitted if it cannot be settled by negotiation (Mandate for Palestine (1922), PDF p.13).

Details

  • Article 26 records the Mandatory’s acceptance of that referral in advance: the Mandatory “agrees that, if any dispute whatever should arise between the Mandatory and another Member of the League of Nations relating to the interpretation or the application of the provisions of the mandate, such dispute, if it cannot be settled by negotiation, shall be submitted to the Permanent Court of International Justice” (PDF p.13).
  • The mandate gives no corresponding route to the inhabitants of Palestine or their representatives; the only parties named in Article 26 are the Mandatory and another Member of the League (PDF p.13).
