Summary

A 2023 law amending the Citizenship Law 5712-1952 and the Entry Into Israel Law 5712-1952 to revoke the citizenship or permanent residency of a person convicted of a terrorist offence and sentenced to prison who received Palestinian Authority money in connection with terrorism, and to deport that person to PA territory or the Gaza Strip at the end of the sentence, which Adalah’s Discriminatory Laws Database presents as an expansion of a separate and unequal citizenship track for Palestinians (Discriminatory Laws Database, lines 76-164).

Details

  • The cumulative conditions are conviction of an offence a court determined to be an act of terror under the Counter-Terrorism Law (2016), or of Penal Law ss.97-99 offences, an actual prison sentence, and proof to the Interior Minister’s satisfaction that the person, or someone acting on their behalf with their knowledge, received money in connection with terrorism (lines 84-90, 108-126).
  • Under the Citizenship Law track (new (b1)), the Minister informs the person within seven working days, the person may present arguments within seven working days, and the court shall revoke unless convinced by detailed special circumstances that revocation is not justified, deciding within 30 days; the provisions apply also to a person left without any citizenship (lines 96-112).
  • On revocation the person is deported at the end of the sentence, under s.13 of the Entry into Israel Law, to the territories of the Palestinian Authority and is no longer allowed to enter Israel (lines 108-112).
  • Adalah sets the law against the 2008 Citizenship Law amendment on “breach of loyalty” (Article 11(b)(2)), upheld in the Zayoud case in July 2021, in which Interior Ministry data showed that of 31 instances in which the state considered revocation, not a single case involved a Jewish citizen (line 143).
