Summary
The March 2014 amendment raising the Knesset electoral threshold from 2% to 3.25%, which Adalah’s Discriminatory Laws Database presents as undermining parliamentary representation of the Palestinian Arab minority in particular, in a Description-only entry (Discriminatory Laws Database, lines 1204-1241).
Details
- The amendment was enacted in March 2014 as an amendment to Basic Law: The Government. Adalah’s account is that it prevents Arab parties from contesting within multiple lists representing their range of beliefs, an instance of the majority imposing its will on the minority (lines 1216-1220).
- In January 2015 the Supreme Court rejected private attorney Yehuda Gutman’s petition to cancel the amendment (decision dated 14 January 2015); Adalah and the Association for Civil Rights in Israel (ACRI) participated as amicus curiae, with their submission dated 21 December 2014 (lines 1222, 1234-1236).
