Summary

Director of the International Justice Division, Office of the Deputy Attorney General for International Law, Ministry of Justice of the State of Israel, counsel and advocate for Israel in South Africa v. Israel (Genocide Convention), who argued the facts on the ground on 12 January 2024 (Verbatim record CR 2024/2 — Public sitting of 12 January 2024, oral argument of Israel (South Africa v. Israel), PDF p.8, p.40-49).

Details

  • She argues South Africa’s picture is partial and deeply flawed on three aspects: Hamas’ military tactics and embedding, including its use of houses, schools, UN facilities and every hospital the IDF has searched; Israel’s efforts to mitigate civilian harm, including over three weeks urging evacuation, millions of leaflets and over 70,000 individual phone calls; and Israel’s humanitarian co-ordination through COGAT (PDF p.41-48).
  • She concludes Israel’s efforts are the very opposite of intent to destroy the population, so genocidal intent is not even a plausible inference (PDF p.48-49).
