Summary

Amendment No. 40 (2011) to the Prisons Ordinance allowing the Israel Prison Service to bar a security prisoner’s meetings with lawyers on suspicion of information transfer to a terror organization, for periods far longer than before, which Adalah’s Discriminatory Laws Database presents as targeting security prisoners, who are overwhelmingly Palestinians, and their generally Palestinian lawyers, in a Description-only entry (Discriminatory Laws Database, lines 1372-1397).

Details

  • The periods under the amendment: an IPS prohibition of 96 hours (previously 24), extendable to 14 days with the state prosecutor’s approval (previously 5); a district court may extend to six months (previously 21 days) up to a maximum of one year (previously three months); and the Supreme Court may extend for unlimited periods after one year (previously Supreme Court supervision was required after three months) (lines 1384-1388).
  • As of May 2012 there were over 4,600 Palestinian political prisoners held as “security prisoners”, in the entry’s figures (line 1384).
