Summary
The United Nations organ Resolution 181 (II) designates as Administering Authority, on behalf of the United Nations, for the City of Jerusalem under its special international regime: it is to elaborate and approve the City’s Statute, appoint its Governor, and re-examine the regime after its first ten years (Resolution 181 (II): Future government of Palestine, PDF p.16-20).
Details
-
Resolution A requests that the Trusteeship Council be informed of the responsibilities envisaged for it in the Plan (Resolution 181 (II): Future government of Palestine, PDF p.1-2).
-
Part III, Section A designates the Trusteeship Council to discharge the responsibilities of the Administering Authority on behalf of the United Nations for the City of Jerusalem, established as a corpus separatum under a special international regime (Resolution 181 (II): Future government of Palestine, PDF p.16).
-
Within five months of the Plan’s approval the Council is to elaborate and approve a detailed Statute of the City containing, among other provisions, a Governor appointed by the Council and responsible to it, chosen on special qualifications without regard to nationality but not a citizen of either State in Palestine; the Governor submits a detailed plan for the organization of the administration to the Council for its approval, and studies and submits for the Council’s consideration and decision a plan for special town units for the Jewish and Arab sections of new Jerusalem (Resolution 181 (II): Future government of Palestine, PDF p.16-17).
-
The Governor controls entry, residence and immigration in the City under the direction of the Trusteeship Council, and the Council makes arrangements for consular protection of the citizens of the City outside its territory (Resolution 181 (II): Future government of Palestine, PDF p.18-19).
-
The Statute elaborated by the Council comes into force not later than 1 October 1948 and remains in force in the first instance for ten years, unless the Council finds it necessary to re-examine the provisions at an earlier date; after that period the whole scheme is subject to re-examination by the Council in the light of the experience acquired (Resolution 181 (II): Future government of Palestine, PDF p.20).
-
Resolution 303 (IV) of 9 December 1949 confirms the Council’s designation as Administering Authority and requests it at its next session to complete the preparation of the Statute of Jerusalem, omitting now inapplicable provisions such as articles 32 and 39, amending toward greater democratization without prejudice to the fundamental principles of Resolution 181 (II), approve the Statute and proceed immediately with its implementation, not allowing any interested Government’s actions to divert it (Part I, paras. 1–2, PDF p.1).
