Details
-
Resolution A requests the Security Council to take the necessary measures provided for in the Plan for its implementation; to consider, if circumstances during the transitional period require it, whether the situation in Palestine constitutes a threat to the peace and, if it decides such a threat exists, to supplement the Assembly’s authorization under Articles 39 and 41 of the Charter so as to empower the United Nations Commission to exercise its assigned functions; and to determine as a threat to the peace, breach of the peace or act of aggression, in accordance with Article 39, any attempt to alter by force the settlement envisaged by the resolution (Resolution 181 (II): Future government of Palestine, PDF p.1-2).
-
The Commission acts under the guidance of the Security Council: as the mandatory Power withdraws, administration is progressively turned over to the Commission, which acts in conformity with the Assembly’s recommendations and under the Security Council’s guidance; the Commission is guided by such instructions as the Security Council may consider necessary, and its measures become immediately effective unless it has previously received contrary instructions from the Council (Resolution 181 (II): Future government of Palestine, PDF p.3, p.6).
-
If by 1 April 1948 a Provisional Council of Government cannot be selected for either State, or cannot carry out its functions, the Commission communicates that fact to the Security Council for such action as it may deem proper; the Commission renders periodic monthly progress reports, or more frequently if desirable, to the Security Council, and makes its final report to the next regular session of the General Assembly and to the Security Council simultaneously (Resolution 181 (II): Future government of Palestine, PDF p.4, p.6).
-
In Resolution 194 (III) the Council is the organ whose 16 November 1948 resolution’s negotiations the parties are called on to extend, which may request the Palestine Conciliation Commission to undertake the Mediator’s or Truce Commission’s Security Council functions, which is requested to take further steps to ensure Jerusalem’s demilitarization at the earliest possible date, to which impediments to access to Jerusalem are to be reported immediately for appropriate action, and to which the Commission’s periodic progress reports are transmitted (PDF p.3-5).
-
Resolution 273 (III) acts on the Council’s report and recommendation on Israel’s application, noting the Council’s judgment that Israel is a peace-loving State able and willing to carry out the Charter obligations (PDF p.1).
-
The Egyptian-Israeli General Armistice Agreement was negotiated in pursuance of the Council’s resolutions of 4 and 16 November 1948, is transmitted to the Council in S/1264/Corr.1, and provides that a dispute unresolved by the post-one-year review conference may be brought before the Council on the ground that the Agreement was concluded in pursuance of Council action toward achieving peace in Palestine (PDF p.1, p.8-9).
-
The Lebanese-Israeli General Armistice Agreement was negotiated in pursuance of the Council’s resolution of 16 November 1948 alone, is transmitted to the Council’s President by the Acting Mediator’s cablegram in S/1296/Rev.1, and provides the same recourse: a dispute unresolved by the post-one-year review conference may be brought before the Council for the relief sought, on the ground that the Agreement was concluded in pursuance of Council action toward achieving peace in Palestine (Lebanese-Israeli General Armistice Agreement, PDF p.3, p.8).
-
The Jordanian-Israeli General Armistice Agreement was likewise negotiated in pursuance of the Council’s resolution of 16 November 1948, is transmitted to the Council’s President by the Acting Mediator’s cablegram in S/1302/Rev.1, and provides the same recourse to the Council after a failed post-one-year review conference (Jordanian-Israeli General Armistice Agreement, PDF p.3, p.10).
-
The Syrian-Israeli General Armistice Agreement was likewise negotiated in pursuance of the Council’s resolution of 16 November 1948, is transmitted to the Council’s President by the Acting Mediator’s communication in S/1353/Rev.1, and provides the same recourse to the Council after a failed post-one-year review conference (Syrian-Israeli General Armistice Agreement, PDF p.3, p.9).
